Definition of terms:

Website – a website located on the Internet at evie.ua

including all its web pages.

Product – goods, images and/or descriptions of which are posted on the Website.

Public offer – a public offer of a sole proprietorship directed to an indefinite number of persons Yuriy Oleksandrovych Trofymenkoregarding the conclusion of an electronic contract for the sale of goods to certain individual entrepreneurs Yuriy Oleksandrovych Trofymenkoconditions.

User/Buyer - is a person who browses the information on the Website and/or orders and/or receives and/or reserves the Goods using the technical tools of the Website.

Recipient - The Buyer or the person who, on behalf of the Buyer, actually receives the Goods delivered by the Carrier Company.

Order - a duly executed and placed through the Website request of the User for the purchase of the selected Goods.

Acceptance - the User's actions aimed at accepting the terms of this Public Offer.

Registration - filling in the appropriate form on the Website by the User, indicating the data necessary for identification.

Personal account - is a page of the Website containing the history of the User's/Buyer's orders made through the Website and the personal information specified during the Registration.

The Buyer's Personal Account may also contain other information necessary to identify the User/Buyer and place orders, the amount of which is determined by the sole proprietor Trofymenko Yuriy Oleksandrovych independently.

1. General provisions

1.1. The information posted on the Website contains the terms of the offer to purchase the Goods and constitutes a Public Offer of the sole proprietorship Trofymenko Yuriy Oleksandrovychaddressed to an indefinite number of persons - users of the Site.

1.2. Acceptance is the fact of registration of the User/Buyer on the Site, which is the expressed intention of the User/Buyer to purchase the Goods selected on the Site.

1.3. By acceptance, the User/Buyer certifies his/her full and unconditional agreement with all the terms and conditions of this Public Offer without any exceptions and limitations, and confirms that he/she is familiar with its terms and conditions before making the Acceptance.

1.4. The Agreement is considered concluded from the moment of registration confirmation.

1.5. Payment for the goods is made exclusively in UAH by bank transfer/cash upon delivery.

2. Information about the Goods, the price of the Goods

2.1. The presented photo samples contain one or more types of goods of a certain article and textual information about the article, available sizes, cost per unit of goods, etc.

2.2 The cost of the goods presented on the Site is indicated including VAT.

2.3 The information posted on the evie.ua website is for informational purposes only.

3. Ordering procedure

3.1. The User/Buyer must independently place an Order for any product that is available for Ordering on the Site.

3.2. In case of absence of the Ordered Goods, the Representative of the sole proprietorship Yuriy Oleksandrovych Trofymenko is obliged to inform the User/Buyer of such information by means of communication left by the User/Buyer when registering on the Site.

3.3. In the absence of the Ordered Product, the User/Buyer has the right to replace it with a Product of a similar model or cancel the Order by calling the Hotline number.

3.4.The User/Buyer has the right to cancel the order by calling the Hotline number.

4. Delivery of goods

4.1 Delivery of the goods ordered on the Site is carried out by delivery services on the territory of Ukraine in accordance with the conditions specified on the Site in the section "Payment and Delivery" or by pickup from the store specified in the Order. Delivery is carried out by the courier service "Nova Poshta".

4.2. Together with the Order, the Buyer shall be provided with the documents required by the current legislation.

4.3. Upon receipt of the Goods, the Buyer shall be obliged to check the goods for quantity, quality, assortment and completeness.

4.4. The fact of acceptance of the Goods by the Buyer is payment for the Goods.

4.5. If the delivery of the Orders is carried out by delivery services (hereinafter referred to as the "Carrier Companies"), by accepting this Public Offer, the Buyer fully and unconditionally agrees to the Rules of Carriage of Goods of the Carrier Companies. The terms of such Rules are available on the websites of the respective Carrier Companies.

4.6. The risk of accidental loss and/or accidental damage to the Goods shall be transferred to the Recipient from the moment the Order is transferred to him/her and the Recipient signs the documents confirming the delivery of the Order.

5. Return of the Goods.

5.1. Return of the Goods of good quality.

5.1.1. The return of the Goods of good quality is carried out in accordance with the Law of Ukraine "On Protection of Consumer Rights" No. 1023-XII of 12.05.1991 (as amended).

5.1.2. The Buyer has the right to refuse the delivered Goods of good quality within 14 (fourteen) days from the date of receipt of the Goods only if the appearance, consumer properties of the Goods, factory packaging, labels and payment document (electronic document, receipt, sales or cashier's check, ticket, coupon or other document confirming the receipt of funds, indicating the date of payment) are preserved.

5.1.3. The return of the Goods of good quality, which were delivered by the Carrier Companies, shall be carried out at the expense of the Buyer.

5.2. Return of the Goods of inadequate quality.

5.2.1. For shoes sold by an individual entrepreneur Trofymenko Yuriy Oleksandrovychhas a warranty period of 30 calendar days from the date of sale or the beginning of the season. In case of defects detected during the established warranty period, the consumer has the right to claim in accordance with the procedure established by the Law of Ukraine "On Protection of Consumer Rights":

1) a proportional reduction in price,

2) free elimination of defects in the goods within a reasonable time;

3) reimbursement of expenses for the elimination of defects in the goods.

5.2.2. In case of returning the Goods that have a significant defect in accordance with the Law of Ukraine "On Protection of Consumer Rights" No. 1023-XII of 12.05.1991 (as amended), the delivery of which was carried out by the Carrier Companies, the sole proprietor Trofymenko Yuriy Oleksandrovych shall refund the money upon return of the Goods. The costs associated with the delivery of such Goods to the Buyer by the Carrier Company shall be covered by the sole proprietor Yuriy Oleksandrovych Trofymenko

5.2.3. Additional provisions on the procedure for the return of goods delivered by the Carrier Companies are indicated in the section of the Site "Return of goods".

6.Rights and obligations of the individual entrepreneur Trofymenko Yuriy Oleksandrovych

6.1. INDIVIDUAL ENTREPRENEUR Yuriy Oleksandrovych Trofymenko has the right to:

6.1.1. Unilaterally suspend the sale of the Goods and the provision of delivery services (refuse to place an Order/sale and delivery of the Goods) in case of violation by the User/Buyer of the terms of the Public Offer;

6.1.2. At its sole discretion, unilaterally change the price of the Goods. In any case, the price of the Goods confirmed by the individual entrepreneur Trofymenko Yuriy Oleksandrovych Order shall remain unchanged;

6.1.3. In the absence of the Goods ordered by the Buyer, the latter has the right to exclude the specified Goods from the Order / cancel the Buyer's Order, without fail notifying the Buyer by sending a corresponding e-mail to the e-mail address specified by the Buyer during registration (or by calling the Call Center operator to the phone number specified by the User / Buyer);

6.1.4. At its sole discretion, unilaterally amend the terms of the Public Offer by posting (publishing) a new version on the Site. The amendments shall enter into force from the moment of their posting (publication), unless another term of entry into force is additionally specified in their publication.

6.1.5. To post on the Website information about advertising and marketing activities conducted or to be conducted by the Seller and/or third party partners of the Seller. Also, in accordance with the terms of this Public Offer and the Privacy Policy, send e-mails to the Users' e-mail addresses with information about news, promotional events, marketing activities, other commercial offers of the sole proprietorship Yuriy Oleksandrovych Trofymenko

6.1.6. Organize the delivery of Orders by engaging third parties to provide delivery services.

6.2. INDIVIDUAL ENTREPRENEUR Yuriy Oleksandrovych Trofymenkoundertakes to:

6.2.1. After confirming the Order, to fulfill properly executed and confirmed Orders;

6.2.2. Deliver the Goods in accordance with the executed Order and the terms of the Public Offer;

6.2.3. To check the quantitative and qualitative characteristics of the Goods during their packaging and preparation for delivery;

6.2.4. In no way disclose information about the personal data of Users and Buyers, passwords and other access data in accordance with the Security Rules posted on the Site;

6.2.5. Provide each User with the opportunity to refuse to receive advertising materials and other commercial offers of the IE Trofymenko Yuriy Oleksandrovychsent by the latter to the e-mail address specified during registration on the Site.

7. Rights and obligations of the User/Buyer.

7.1. The User/Buyer has the right to:

7.1.1. Select the Goods, place and send an Order on the relevant pages of the Site;

7.1.2. To demand from the individual entrepreneur Trofymenko Yuriy Oleksandrovych to fulfill the conditions and obligations stipulated by this Public Offer;

7.1.3. To refuse to receive advertising materials and other commercial offers of the sole proprietorship Trofymenko Yuriy Oleksandrovych sent by the latter to the User's e-mail address.

7.2. The User/Buyer undertakes to:

7.2.1. By the time of Acceptance of this Public Offer, to familiarize themselves with all its terms and conditions;

7.2.3. To familiarize themselves with the information about the Goods (its description), which is posted on the Site, before placing and sending the Order;

7.2.4. Duly pay for and receive the Order issued in accordance with the terms of this Public Offer;

7.2.5. When registering and/or placing an Order, provide the sole proprietor with Trofymenko Yuriy Oleksandrovych all the information necessary for the delivery of the Order. The User/Buyer is solely responsible for providing false information that has led to the impossibility of proper execution of the Order. Yuriy Oleksandrovych Trofymenko to properly fulfill its obligations to the Client/Buyer.

7.2.6. Upon receipt of the Order, verify the integrity and completeness of the Goods by inspecting the contents of the Order. In case of damage or incomplete completeness of the Goods, record all differences in the Act, which, together with the Buyer, must be signed by the person who delivered the Order.

7.2.7. To familiarize yourself with the Rules of cargo transportation of the Carrier Companies before placing the Order.

8. Responsibility of the parties. The procedure for resolving disputes.

8.1. INDIVIDUAL ENTREPRENEUR Yuriy Oleksandrovych Trofymenko is not responsible for the quality of public communication channels and possible interruptions in the data transmission network (including, but not limited to, the global Internet) through which the Website is accessed.

8.2. Any complaint or claim of the User/Buyer must be made in writing. INDIVIDUAL ENTREPRENEUR Yuriy Oleksandrovych Trofymenko all necessary measures will be taken to satisfy the User/Buyer's complaint/claim, if such complaint/claim is substantiated and executed in accordance with the current legislation of Ukraine.

8.3. All disputes, disagreements or claims arising out of or in connection with this Agreement, including those related to its performance, violation, termination or invalidity, shall be resolved in the appropriate court in accordance with the substantive and procedural law of Ukraine, subject to the conditions of jurisdiction and jurisdiction.

9. Force Majeure.

9.1. The Parties shall be released from liability for untimely or improper fulfillment of their obligations if such failure is the result of extraordinary circumstances, the occurrence of which is not related to the will of the Parties, such as military operations, strikes,

riots, accidents, natural disasters, changes in the legislation of Ukraine, as well as other extraordinary circumstances that arose after the conclusion of this Agreement and directly affect the fulfillment of the terms of this Agreement and which the Parties could neither foresee nor prevent.

9.2. The Party for which it has become impossible to fulfill its obligations due to the occurrence of force majeure shall immediately inform the other Party in writing of the occurrence of the above circumstances, as well as provide the other Party with confirmation of force majeure within thirty (30) calendar days. Such confirmation will be a relevant document issued by the authorized Chamber of Commerce and Industry of Ukraine or other duly authorized state body located at the place of occurrence of force majeure.

10. Warnings regarding the collection and processing of personal data.

10.1. Upon acceptance of the Agreement, the User/Buyer agrees to the collection and processing of personal data in accordance with the Law of Ukraine of June 01, 2010 No. 2297-VI "On Personal Data Protection".

10.2. Any information received from the User/Buyer will never and under no circumstances be provided to third parties, except as provided by the current legislation of Ukraine.

10.3. The information provided by the User/Buyer is used in the processing of the Order, as well as to provide the User/Buyer with commercial offers of the sole proprietorship Trofymenko Yuriy Oleksandrovych

10.4. Personal information can be changed, updated or deleted at any time in the "Personal Account" section.

10.5. In order to provide the User/Buyer with information about the products posted on the website, the sole proprietor Trofymenko Yuriy Oleksandrovych may send information messages to the e-mail address specified during registration.

10.6. The personal data of the User / Buyer is processed in accordance with the Law of Ukraine dated June 01, 2010 No. 2297- VI "On Personal Data Protection" and the Security Rules specified in the "Security" section of the Site.

11. Other.

11.1. To the relationship between the User/Buyer and the sole proprietor Trofymenko Yuriy Oleksandrovych the provisions of the current legislation of Ukraine apply.

11.2. Photos of the Goods contained on the pages of the Site may differ from the actual appearance of the Goods. The descriptions/characteristics accompanying the Goods do not claim to be comprehensive and may contain typographical errors. To clarify information about the Goods, the User should contact the Hotline number.

11.3. INDIVIDUAL ENTREPRENEUR. Trofymenko Yuriy Oleksandrovych may audio record conversations on the Hotline using appropriate telecommunication equipment, provided that the Users/Buyers are notified of the fact of audio recording by means of an oral warning. Such recording may be made by the sole proprietor Trofymenko Yuriy Oleksandrovychto exercise his rights and legitimate interests, as well as to improve the quality of services, etc. FOP Trofymenko Yuriy Oleksandrovych is guided by the statement that the User / Buyer who does not agree with the audio recording of the conversation has the opportunity not to continue communication with the Hotline operator after receiving a notification of audio recording.

11.4. FOP Trofymenko Yuriy Oleksandrovych reserves the right to expand and reduce the product offer presented on the Website.
